Rep. Cherry has introduced HB 1068 which I only mention because it seems to be moving through the General Assembly like shit through a goose.
It was introduced on January 7, passed out of committee on January 10, passed second reading on January 14, and passed on third reading on January 15.
Looks like MAP-21 is a federal law that involves, among other things, transportation carrier regulations. I’m assuming that it allows states to exempt agricultural carriers and vehicles involved in agricultural operations and Indiana’s exercising that discretion.
The Indiana motor transportation laws incorporates certain federal regulations by reference as regulations that must be complied with; but this legislation would specifically exempt from incorporation federal hours of service rules applying to commercial motor vehicle operators engaged in the transportation of agricultural commodities and farm supplies and federal rules concerning federal motor carrier safety regulations applying to the operation of covered farm vehicles by farm and ranch operators, employees of farms and ranches, and other individuals.concerning federal motor carrier safety regulations apply to the operation of covered farm vehicles by farm and ranch operators, employees of farms and ranches, and other individuals.

During harvest, the trucks run from the fields to the elevator day and night. A lot of these guys are getting by on 4 hours or less of sleep.
I’ll have to remember to ask about the sleep situation if I ever represent someone who gets in an accident with a truck involved in agricultural operations.
Yeah, harvests run around the clock, anymore. And sleep deprivation is part of the routine.
When I was in High School I would come home from ball practice and sit on a combine or until 10 or 11.
Don’t forget to include the State in any such suit. Their choice.
